  • TDL Equipment, formerly Terex Distribution Limited, has decided to end its construction machinery dealership arrangements with Sany, Genie and Mecalac.

    TDL, part of the Ballyvesey Holdings group, is closing its recently-opened Coatbridge facility by the end of January and consolidating its business to focus solely on Atlas scrap and waste handling machinery.

    Dealer principal Andrew Taylor said that the decision to stop selling Sany products came on the back of declining excavator sales in the UK and the Chinese excavator manufacturer’s recent announcement that it was setting up a UK office and seeking to build a network of dealers. “This removes the exclusivity that we enjoyed,” Andrew Taylor said. “This change means TDL have had to review how it covers GB, and have decided in the best interest of TDL to withdraw selling and supporting this product with immediate effect.”

    He added: “On the back of the Sany decision we have also decided to terminate our current dealership relationship with Genie and Mecalac. We are working with Sany, Genie and Mecalac to support transition to other dealers.”

    TDL had been representing Sany since 2014 in addition to what were then Terex products.

    General buzz around the machinery forums this past couple of weeks has been the likely demise of Komatsu’s biggest, and in fact the world’s largest crawler dozer the D575A-3 Super Dozer.

    Nothing official has been announced by Komatsu as yet, but it appears that the 1,150 hp/860kw D575A-3 Super Dozer has been discontinued from the product range, having been in Komatsu’s product portfolio since it was first introduced in 1991. The machine was a massive dozer capable of moving 125 cubic yards (96m3) of material in one pass!

    General consensus is that it is no longer a viable product to include in the company’s range, with only one 575 sold for every twenty 475’s. However with large scale mining operations in the United States, Canada and Australia still very prominent, one would think there must still be a market for a large “mega dozer”. Not many of us will have been lucky enough to have seen a Komatsu D575 in action in the flesh, but check out this video which features 2 of them in an awesome display of dozing capability in New Zealand.

    Coronavirus: infectious disease outbreaks and construction projects

    Construction projects are likely to be affected by the novel coronavirus outbreak. The nature and scale of any impact cannot be predicted accurately at this point, but labour and supply chain issues are increasingly foreseeable. What happens if it impacts your project?

    It depends on the contract

    If a construction contract lacks an express term allocating the risk of infectious disease outbreaks, such as COVID-19, parties will need to rely on other provisions, such as extension of time and loss and expense clauses, to understand who bears the risk. To illustrate, we have looked at how these clauses might operate under the commonly used JCT DB 2016 standard form. Other forms, including NEC, FIDIC and PFI contracts, will take different approaches.

    Is the contractor entitled to an extension of time?

    A contractor may be entitled to an extension of time, and to avoid paying liquidated damages, if an excusable delay event occurs causing critical delay to the project. The list of excusable delay events (referred to as “Relevant Events”) is set out at clause 2.26 and includes two which may apply during an infectious disease outbreak:

    the exercise after the Base Date by the United Kingdom Government or any Local or Public Authority of any statutory power that is not occasioned by the default of the Contractor or any Contractor’s Person but which directly affects the execution of the Works, and

    force majeure.

    Under clause 8.11 of the standard form, either of these Relevant Events may also ultimately entitle the employer or contractor to terminate the contract if the whole or substantially the whole of the uncompleted works are suspended for more than two months (unless otherwise amended). Termination is a high risk option and the commercial implications must be considered very carefully.

    Is the employer required to pay compensation?

    Under the standard form, a contractor is not entitled to recover loss and expense, such as prolongation compensation, simply because it obtains an extension of time. Instead, a contractor must separately establish a “Relevant Matter”. The list of Relevant Matters is at clause 4.21 of the standard form, but an infectious disease outbreak does not fit in to any of these categories. This means that an employer is unlikely to be required to pay compensation under the unamended JCT contract, but a contractor should carefully check other provisions (such as fluctuations) or insurances (such as business interruption) in case recovery is possible through other routes. There is a clear risk of knock-on insolvency caused by disease related business disruption.

    What should I do now?

    The UK government is keen to reduce the spread of the novel coronavirus whilst ensuring the country continues to run as normally as possible. We hope this allows parties to complete projects as planned whilst protecting vulnerable individuals.

    If you think your project is exposed to risks arising from the outbreak of an infectious disease, check the contract and consider:

    Notification – a contractor is usually obliged to provide notices “as soon as it becomes reasonably apparent” that the progress is being or is likely to be delayed and follow up with more information. There may be a strict deadline that, if missed, bars the contractor from any entitlement.

    Mitigation – the contractor is usually required to constantly use best endeavours to prevent delay, even if the delay event is not its fault. An employer might want to instruct resequencing, additional manpower or reduction in scope.

    Evidence – extension of time claims are often heavily contested through adjudication. The short timetable favours the party with the best organised records. Careful evidence of causes of delay, mitigation attempts and decision making always helps.

  • How will the coronavirus affect global construction commodities?

    The coronavirus originating from Wuhan, China, is anticipated to negatively impact the global trade of raw materials in the coming months. According to market analytics company S&P Global Platts, the consumption and processing of commodities like iron ore and steel are likely to dip throughout the country and cause ripple effects in economics throughout the world. What’s not clear is how severe the situation will get.

    In late January, China announced it would shut down over two-thirds of its economy due to the outbreak that started in Wuhan city. Since the Chinese Lunar New Year began as the virus spread, many companies across the mainland have halted production and construction crews have paused work as an extension of the holiday break. Fourteen provinces, including the major manufacturing hub of Hubei where Wuhan is located, and other metropolitan areas such as the port city of Shanghai, will be on lockdown until next week. Fortune noted that those regions make up 90 percent of the country’s copper smelting, 60 percent of its steel manufacturing, and 40 percent of coal output.

    Normally during Lunar New Year, companies stop or reduce production, but the recent three-day extension of the holiday—largely due to transportation restrictions to and from quarantined areas and to encourage people to stay home—may cause an added riff in planned-manufacturing and eventually quarterly sales. Bloomberg noted that any changes in China’s steel industry, specifically, “which accounts for more than half global output, set the tone for producers and users around the world.”

    Some experts say the impact won’t be felt until next month—S&P Global Platts said February is typically the weakest time of the year for metal output in China since demand is low due to the holiday. Construction is also normally slow because of the colder weather. London-based analytics organization Argus believes after the extended Lunar New Year break is officially over, the market for products like rebar and coil will drop while “the downstream market will be reduced, pushing back demand for finished steel products.”

    Despite these fears, China’s most influential steel group, the China Iron and Steel Association (CISA), called for industry stability and asked steel companies not to inflate steel prices because of the declining demand. Reuters reported that CISA wants mills to “reasonably adjust their production rhythms” and “jointly safeguard hard-won ‘de-capacity’ results” in order to maintain profitability and reach levels of normalcy later in the year.

    Both in China and worldwide, the long-term effects of the coronavirus are still up in the air. The World Health Organization reported this week that 24 countries have confirmed cases of the outbreak, though most resulted from contact with people who had come directly from China and Wuhan, where 563 people have died. Meanwhile, China is expected to lift its tariff on coking coal, which is used for making steel soon, leaving some U.S.-based mining companies ready to once again sell in the Chinese market.

    – Organise clock-in and office hours at staggered times, so that employees can keep a good distance from one another, in relation to e.g. getting dressed and eating

    – Have breaks outdoors when the weather permits, or in the company car

    – Use your own tools wherever possible

    – Cancel meetings that are not urgent, or hold them via telephone or outside of the building

    – Work from home whenever the task allows

    • Prioritise regular cleaning and sanitizing

    For example:

    – Clean or sanitize more regularly than usual

    – Clean handles, surfaces and toilets several times per day

    – Ensure that there is frequent ventilation in site offices, etc.

    – Wipe tables between dining times

    – Washtables and chairs in meeting rooms

    – Do not forget the coffee machine or microwave

    At construction sites with more than one employer, the developer’s work environment coordinator must coordinate the companies’ measures against the spread of infection in collaboration with the companies and their work environment organisation.

    The rules for employees that conduct work in private homes are the same as for all other work roles. This means that the employer must assess whether there is a risk that the employees may be exposed to coronavirus infection from e.g. customers and residents. If this is the case, the employer must implement measures that may prevent the risk of infection as effectively as possibly.

    The Danish Work Environment Authority encourages that companies follow the Danish Health Authority’s guidelines for minimising infection, including that the companies contact the customer/resident to clarify whether it is responsible to conduct the visit.

    If someone in the home is infected, the Danish Health Authority recommends that one does not conduct the visit at the current time.
